CYBERMEDIAÒ SUES SYMANTEC FOR COPYRIGHT INFRINGEMENT AND THEFT OF TRADE SECRETS
Suit Alleges Symantec’s Product is a Modified Copy of CyberMedia’s UnInstallerÔ Program
SAN JOSE, CA –(February 5, 1998) – CyberMedia’sÒ (NASDAQ\NMS: CYBR) today filed suit against Symantec Corporation (NASDAQ:SYMC) in the Northern District of California asserting claims for copyright infringement and theft of trade secrets.
According to the suit, the computer code in Symantec’s product, Norton Uninstall Deluxe, was derived from an earlier version of CyberMedia’s competing UnInstallerÔ program. CyberMedia seeks compensatory and exemplary damages and has asked the court to order Symantec to stop selling its product and recall all copies of the product from distributors and retailers.
"Among the dozen or more software products on the market today designed to remove unwanted applications and files from a personal computer, CyberMedia’s UnInstaller has been the market leader and consistently recognized as the best," said Bob Davis, CyberMedia’s vice president of marketing. "In visual appearance, operation and design, Symantec’s product is strikingly similar to an early version of UnInstaller, right down to some of the same computer bugs."
The suit also named as defendants computer software developer ZebraSoft, Inc., of Atlanta, Georgia, and its founders Timothy O’Pry, Thomas Lynch, and Snehal Vashi who claim to have authored Symantec’s program. The individual defendants were formerly with MicroHelp, Inc., the company that developed the early versions of UnInstaller which CyberMedia acquired.
